ง บทคัดย่อภาษาอังกฤษ Abstract Thesis Title : Development of Guidelines for the Protection of Elderly Suspect’s Rights Before Criminal Prosecution Student's Name : Mister YUTTHACHAI DUANGSAWAT Advisory Committee : Professor Dr. KORAKOD TONGKACHOK Degree and Program : Master of Laws in Laws Academic Year : 2022 This research study aimed to present problems of the criminal justice process before the criminal prosecution of elderly suspects. The study proceeded through document analysis via related laws, Thai Constitution 2017, Criminal Procedure Code of Thailand, The Elderly Act 2023, and directive of the Royal Thai Police no. 419/2013 entitled justice facilitation in criminal cases, also evidence gathering for the inquiry process, and measures to control and check, and in-depth interviews with ten samples. The research findings revealed that at present, Thailand is an aging society. It indicated that the population of Thailand has an increased number of elderlies; as a result, the government should be aware of access to the justice process for elderly suspects. Furthermore, issues, such as information access, answering questions, or contention, are often problematic for the elderly aged sixty and above who may be faced with problems relating to mental issues, therefore, they are one of the most vulnerable groups. As a result, factors causing criminal fault may not be from their habits, but from physical and mental health problems. The elderly should be seen as people in a vulnerable group who may not have the capacity to think rationally or lose their mental ability, therefore, the Criminal Procedure Code and Elderly Act 2003 should be adjusted for this vulnerable group, and due diligence more appropriate for the rights and freedoms of the elderly should be observed when faced with criminal prosecution.
