จ บทคัดย่อภาษาอังกฤษ Abstract Thesis Title : Legal Measures to Control Social Media Bullying Student's Name : Miss PUNTARIK KERDTIP Advisory Committee : Assistant Professor Dr. Jidapa Pronying Degree and Program : Master of Laws in Laws Academic Year : 2023 This research aimed to study the legal measures relating to cyberbullying and the exploitation of the right or freedom of opinion and expression that can be used as a tool to violate another person's right to privacy and may be against the Constitution. A qualitative research method was used including document analysis and an in-depth interview. The concepts and theories in the Constitution of the Kingdom of Thailand, B.E. 2560, were analyzed in this research, as well as related laws of Thailand, including international law and foreign laws in four countries namely; Canada, the United States of America, the Commonwealth of Australia, and Japan. The research found that cyberbullying is considered a privacy violation which is protected according to the Constitution of the Kingdom of Thailand, B.E. 2560, although Thailand does not have specific laws to directly protect the rights of individuals from online harassment, thus only the Criminal Code, the Civil and Commercial Code, the Computer Crime Act B.E. 2550, and its amendments (2nd edition) B.E. 2560, can be applied. However, the aforementioned laws do not cover all cases of cyberbullying. The Personal Data Protection Act B.E. 2562 could be partially adapted, but this is not enough to prevent and deter online bullying via social media, which is becoming increasingly prevalent.
