จ บทคัดย่อภาษาอังกฤษ Abstract Independent study Title : Legal Problems in Controlling Donations Through Social Media Student's Name : Miss PHATCHARAPORN RUANGPENG Advisory Committee : Assistant Professor Dr. ARNON SRIBOONROJ Degree and Program : Master of Laws in Laws Academic Year : 2023 This research aimed to study the problems and obstacles preventing the legal enforcement and control of donation requests in Thailand, and study the definitions, characteristics, concepts, and theories in Thai law relating to such requests through social media platforms to propose guidelines and legal measures to better control donation requests via social media. A qualitative research method was employed including documentary research and in-depth interviews. The research found that the Fund-Raising Control Act B.E. 2487 (1944) for controlling donation requests by the private sector does not have provisions addressing the current situation in terms of definitions, characteristics, collecting methods, government supervision, and penalties. Therefore, the government is unable to use its authority to control the donation requests, causing the burden to be passed on to the people who donated, and the donors must monitor and control donation recipients to follow the purposes of the donations. Therefore, this research proposes to amend the Act to be clearer and include donation requests through social media platforms and related channels, to solve the problems, and to fill the gaps in the law. Government officers should be given clear authority with detailed conditions and methods to supervise donations from the beginning to the end to assure transparency and verifiability. Moreover, the penalties, which are an important mechanism to protect donors, should be amended
