ง บทคัดย่อภาษาอังกฤษ Abstract Independent study Title : Review of National Anti-Corruption Commission Resolution based on Measure 99 of Organic Act on National Anti-Corruption Prevention and Suppression B.E. 2561 Student's Name : Mister PATTRAWUT CHAWENIL Advisory Committee : Assistant Professor Dr Jidapa Pronying Degree and Program : Master of Laws in Laws Academic Year : 2023 This research study aims to: 1) study criteria to review the National Anti- Corruption Commission resolution; 2) investigate the right of resolution review of the defendant in cases of adding measures giving the defendant the right to be aware of the resolution; and 3) examine the advantages of the National Anti- Corruption Commission Resolution consideration process specification. This is qualitative research conducted through documentary analysis and an in-depth interview. The research findings revealed that the time duration specified in the circular notice on practical guidelines of the National Anti- Corruption Commission violated the parent law and the limitation of disciplinary violations on the defendant’s rights to know the faults violated by the Constitution of the Kingdom of Thailand, B.E. 2560. In addition, it violated universal human rights. If resolution review consideration process specification to clarify the process and be a guideline for practice had been added, it would have guaranteed the consideration that it followed the rule of law, legal state, and legitimacy of the administration. It suggested that the researcher should draft the Anti-Corruption Commission Regulations on Request for Review of the National Anti-Corruption Commission Resolution that is divided into four categories with fifteen items to protect the rights of government staff as defendants in disciplinary violations to be consistent with the Constitution of the Kingdom of Thailand, B.E. 2560.
