ง บทคัดย่อภาษาอังกฤษ Abstract Thesis Title : Legal Measures to Protect the Rights for Prisoners with Mental Illness during Incarceration Student's Name : Miss PAWARISA IADTIM Advisory Committee : Professor Dr. KORAKOD TONGKACHOK Degree and Program : Master of Laws in Laws Academic Year : 2023 This research study aimed to investigate problems of screening prisoners with mental illness to protect rights during incarceration connected to concepts, theories, principles, Thai laws, and international laws related to problems of screening prisoners with mental illness to be protected in terms of rights during incarceration and to find out guidelines for developing laws for screening prisoners with mental illness to be protected during incarceration. This is qualitative research, studying related documents and conducting in-depth interviews. The research findings revealed that Royal Decree Act B.E. 2560, section of rights of prisoners, basically identifies screening and taking care of prisoners with mental illness only, but in practical, there are many prisoners who do not inform mental information or they do not follow the doctor’s advice, causing difficulty of control, and there are difficult steps when they are released from the prison because there are no laws to enforce or certify for other institutions taking care of mental patients. As a result, the prisoners with mental illnesses are not medically taken care or after the release. Despite their release, the mental symptoms persist. It was suggested to launch regulations integrated with other related public organizations, such as provincial hospitals, to take care of and protect the rights of prisoners with mental illness both during incarceration and after release to increase comfortability in coordinating or asking for information immediately and more quickly. There should be a draft of Department of Corrections regulations about protection and taking care of the rights of prisoners with mental illness under Clauses 55 and 56
