Abstract Thailand ratified the Convention on the Rights of Persons with Disabilities 2006, which enter into force on August 28, 2008, which is necessary to amend laws for the convention consistency. Section 32 of Thailand Civil and Commercial Code stipulated as a criterion, which restrict some part of disability competency and may inconsistency with Article 12 of Convention on the Rights of Persons with Disabilities 2006 because the restriction of disability competency is not respect legislative intent and disabilities will and is inconsistency with principles of the freedom to make one’s own choices and principle of independence of persons in accordance with Article 3 of Convention on the Rights of Persons with Disabilities 2006. Accordingly, it is necessary to amend Section 32 of Thailand Civil and Commercial Code for the Convention on the Rights of Persons with Disabilities 2006 consistency.
