P. 269. โดยในอนุสัญญาแห่งสหประชาชาติว่าด้วยการป้องกันและการลงโทษการกระทำ�ความ ผิดฐานฆ่าล้างเผ่าพันธุ์ “Convention on the Prevention and Punishment of the Crime of Genocide” ค.ศ.1948 ได้บัญญัติให้บุคคลผู้กระทำ�ความผิดฐานฆ่าล้างเผ่า พันธุ์และความผิดอื่นๆ ที่ระบุไว้ในอนุสัญญาต้องถูกลงโทษ ไม่ว่าบุคคลนั้นจะเป็นผู้ ปกครองของรัฐเจ้าหน้าที่รัฐ หรือปัจเจกชนก็ตาม 19 นอกจากนี้การกระทำ�ความผิดฐานกระทำ�การอันเป็นโจรสลัด (piracy) ก็เป็นอีกตัวอย่างหนึ่งที่แสดงให้เห็นถึงสถานะของปัจเจกชนที่ต้องมีความรับผิดใน ทางระหว่างประเทศ ซึ่งเป็นที่ยอม รับกันโดยจารีตประเพณีระหว่างประเทศ (international customary law) ว่าปัจเจกชนซึ่งกระทำ�การอันเป็นโจรสลัดใน ทะเลหลวง (high sea) ย่อมสามารถถูกลงโทษโดยรัฐที่จับกุม (apprehending state) ได้ ซึ่งในปัจจุบันหลักเกณฑ์ดังกล่าวได้รับการบัญญัติไว้ในอนุสัญญาว่าด้วยกฎหมายทะเล “United Nations Convention on the Law of the sea” ค.ศ.1982 20 โดยเฉพาะอย่างยิ่งเมื่อได้มีการจัดตั้งศาลอาญาระหว่างประเทศ (International Criminal Court : ICC) ขึ้นในปี ค.ศ.2002 โดยธรรมนูญกรุงโรมว่าด้วย ศาลอาญาระหว่างประเทศ (Rome Statute of the International Criminal Court) ส่งผลให้การดำ�เนินคดีอาญาในทางระหว่างประเทศ ตลอดจนการบังคับการให้เป็นไป ตามกฎหมายต่อปัจเจกชนที่ได้ก่ออาชญากรรมอย่างร้ายแรง (most serious crime) ที่อยู่ภายใต้เขตอำ�นาจศาล อันได้แก่ อาชญากรรมฆ่าล้างเผ่าพันธุ์, อาชญากรรม ต่อมนุษยชาติ, อาชญากรรมสงคราม และอาชญากรรมรุกราน 21 มีความชัดเจนและ เป็นไปได้ในทางปฏิบัติมากยิ่งขึ้น 19 Convention on the Prevention and Punishment of the Crime of Genocide 1948, Article 3 stated that : Persons committing genocide or any of the other acts enumerated in article 3 shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals. 20 Dr. P.K. Menon, supra note. pp.174-175. 21 Rome Statute of the International Criminal Court 2002, Article 5 par. 1 stated that : The jurisdiction of the Court shall be limited to the most serious crimes of concern to the international community as a whole.
