Human rights and statelessness A. Recognition of the individual as subject of international law Only state and international organization have legal status under the traditional theory of international law. In contrast, the result of internalization of human rights provides individual become partial subjects of international law. 4 According to the Universal Declaration of Human Rights ( UDHR) article 15 and the Convention on the Rights of the Child 1989 (CRC) article 7 and 8 as well as article 24(3) of the International Covenant on Civil and Political Rights ( ICCPR), provide that State oblige individuals within its territory enjoy the right to obtain nationality. In general, state applies 2 significant elements for granting nationality to individual. The first rule called “jus sanguinis” which means no matter of where children are born, they will get the nationality of their parents because of blood origin. And the other principle called “jus soli”, explains that state will grant nationality to children who are born within its territory. 5 Nevertheless, in the Roghingyas case, applying these principles tend to be a problematic. B. What is a problem of becoming stateless person The 1954 Convention relating to the Status of Stateless Person ( the UN convention 1954) article 1(1) provides that “Stateless person” means a person who is not considered as a national by any state under the operation of its law.
