Nevertheless, the term of de jure stateless persons is not defined in the UN Convention 1954 11 . In Rohingyas situation, it is clear that Rohingyas are de jure stateless as it was interpreted in the Summary Conclusions of the Prato Expert Meeting of article 1(1) of the UN Convention 1954 that individual can become stateless if state where he or she has a factual attachment denies to grant that person as its nationality. 12 Why does GOM deny to grant Burmese national to Rohingyas? Because the 1982 Burma Citizenship law allows GOM to do this. The problem of the 1982 Burma Citizenship law Under the 1982 Citizenship law, Rohingyas are denied to obtain their citizenship. 13 The law states that there are only 8 national races 14 recognized as a Myanmar citizen and according to the list, Rohingyas are placed in the session 2 (e) which provides that “Foreigner means a person who is not a citizen or an associtate citizen or a naturalized citizen. This law has led to justify systematic arbitrary and treat against the Rohigyas in a discriminating manner. Because of this racist law, they also have experienced problem of limitation of movement and the right to life as well as accessing to civil services. This includes but not limit to the right to health and education and are subject to force labor and prosecution. 15 11 UNHCR the UN Refugee Agency.
