How can human rights be implemented to Rohingyas? Under international law, states have to do what they commit to do. Futhermore, the UN human rights treaties require states must respect, protect and fulfill the rights of individuals within their territories. 19 According to annual report 2013 of Amnesty International claims that Rohingyas faced with several kinds of human rights violation include physical abuse, rape, destruction of property and unlawful killings by GOM. 20 The principle of Pucta sunt servanda requires state party to respect and comply with the agreement which state singed or ratified and state should comply with this principle in good faith. 21 GOM clearly breaches human rights treaties for instance UN Charter article 55 (c) “Universal respect for, and observance of, human rights and fundamental freedoms for all without distinction”, under CRC article 37 and article 2 provides that all children who become stateless prohibit from torturing and all kind of inhuman treatment and CEDAW article 2 22 provides the prohibition on all kinds of discrimination of Female stateless. In this case, GOM oblige to protect, respect and fulfil the rights of individuals in state’s territory regardless of nationality. In international human rights context, state is allowed to bring case about violation of international human rights instruments before International Court of Justice (ICJ) even none of its nationals are affected because it is the character of human right obligations called erga omnes.
