Abstract Kleptomania is a disease, which classified in a group of habit and impulse disorder according to International Statistical Classification of Diseases and Related Health Problems (ICD-10). However, kleptomania is not a mental disorder disease and the symptom also it is not a mental defect or mental infirmity. That kind of person is a group of habit and impulse disorder. Consequently, if a person commits the offences of theft because of being Kleptomania, there is no excuse to claim of loss unconsciousness according to section 65 of the Criminal Code.
