BIMCO also encourages the parties to decide case by case to add the Extension of Cancelling Clause if they feel favour and appropriate. 32 The redelivery clause has its own Clause 4, while in the previous version some aspects have coped with the hire clause. It has modernised wording, which will encourage the parties to ensure that the instruction on final voyage given by the charterer can be reasonably expected to allow redelivery before or taking place on the date notified to the shipowner. This is satisfactory to the shipowner by way of the position under English law, where the charterer gives the approximate notice of redelivery which is stated “without guarantee” or “without prejudice”.
