Fuel and Bunkers Bunkers play the essential role in the profitability of the time charterparty. Clause 9 of NYPE 2015 has been amended, with comprehensive detail to cover all possible matters in relation to bunkers within the scope of the charterparty. This clause is based on the current industry standards, utilising the International Convention for the Prevention of Pollution from Ships (“MARPOL”) and International Organization for Standardization (“ISO”) frameworks. The clause comprises of 7 paragraphs, which range from quantities and price, quality and liability, fuel sulphur content, bunkering prior to delivery/redelivery, bunkering operations and sampling and grades and quantities on redelivery. 42 As usual, the charterer will be responsible for bunkers on delivery and the shipowner on redelivery. In the case of Res Cogitans, 43 there may be raised some arguments regarding the passing of the bunkers’ ownership in cases where the vessel is bunkered by the charterer prior to redelivery under the time charterparty.
