the intention of Clause 9, or whether it would be the breach of charterparty. 45 Performance of Voyage The new clause in Clause 12 is Speed and Con- sumption, providing enhanced clearness and certainty on these matters that would previously have been contained within the riders. Sub-clause 12(a) applies to the vessel’s speed and fuel consumption, and is the continuing warranty of performance throughout the charterparty, rather than only at the time of delivery. This leads to more burden being placed on the shipowner. The charterer now has the option of choosing a weather routing company for the performance analysis in Sub-clause 12(b) and to follow its advice provided. This Sub-clause seems quite beneficial to the charterer. However, Sub-clause 12(d) is not in favour of the charterer, with claims that it limits to compensation for the time lost and/or additional fuel consumed.
