In sub-clause 12(e), in cases where the claim on underperformance or additional fuel cost consumed arise, the charterer and the shipowner refer to the independent expert, or the alternative weather routeing service to be mutually agreed. This provision aims to reduce time and expense involved in the performance of the claims. Nevertheless, this clause does not stipulate the resolution to deal with the situation when the parties fail to agree on the common set of the expert or the weather routeing service. In these situations, the dispute may be referred to the arbitration, possibly using the single joint expert determined by the court. 47 The clause relates to Slow Steaming Clause. 48 Normally, the shipowner is undertaken to perform voyages with the due despatch, as is clear from The Pearl C. 49 If they cannot conform due despatch duty, the third parties such as the holder of the bill of lading may be entitled to recourse. 50 The decision in The Hill Harmony 51 about slow steaming was not the consequence of the negligent mistake in the navigation or management of the ship under Article IV Rule 2(a) of the Hague Rules, and it had the breach of due dispatch duty if the master did not choose the fastest or shortest route.
