There may be tension in the interests between the shipowner and the charterer, such as when the charterer employs the ship, undertaking to pay fuel while the shipowner requires the specific quality of the fuel to avoid damage to the engine and other equipment, and also conform to the pollution law. 56 The clause also involves BIMCO Hull Fouling Clauses 57 , which require the shipowner to maintain the hull and other underwater parts without fouling in the efficient state. The shipowner will indemnify to the charterer if he fails to perform this duty. However, it requires underwater inspection or cleaning, placing demands on the charterer’s time, expense and risk in case of the port stay over 15 days or other agreed period due to the charterer’s order.
