Spar Shipping AS v. Grand China Logistics Holding (Group) Co. Ltd, 63 Popplewell J declined to follow The Astra, and held that hire payment by the charterer was not the condition of the charterparty. The new clause makes it clear that shipowner can claim damages for loss due to the early termination of the charterparty from the charterer to cover the remaining period. He does not have to establish the breach is repudiatory. Unlike NYPE 2015, in other versions of NYPE, if it is not a repudiatory breach, the shipowners can claim only the damages for hire due at the withdrawal time. 64 The clause furthermore presents the suspension right of the shipowner at any occasion that hire is unpaid. This right is the effective alternative method in the event that the withdrawal of the vessel has disadvantages rather than the suspension right. The suspension may be raised immediately once the hire is not paid on the date due, and is not reliant on any grace period, 65 while NYPE 1993 gives the right of suspension after the grace period has ended for nonpayment of hire. The hire would continue to accrue for the duration of this period.
