Piracy Clause is stated in Clause 39, which regulates the contractual relationship between the parties relating to piracy risks. The clause broadly reflects the words of the BlMCO Piracy Clause for Time Charterparties, when the latest version was issued in 2013. BlMCO Piracy Clause is now generally applied in almost all charterparties. Parts of clause 39 is no more than a reiteration Clause 34, even though it identifies the costs concerning the piracy. The charterer is liable for the additional premium and any addition costs of insurance required by the shipowner, such as the Kidnap and Ransom insurance when the vessel is performed in the area exposed to piracy risk. In addition, off-hire issues have also been included in the clause. 81 These are under the amendment of 1946 version by Gross J in The Saldanha 82 and Cooke J in The Captain Stefanos . 83 Piracy is likely to decrease, 84 so the application of the clause might be comparable to the enhancement of the scheme for fighting during the last war.
