2013 (Clause 39), stowaways (Clause 42), ISM/ISPS Codes (Clause 44/45), sanctions (Clause 46), EU advance declaration (Clause 50) and ballast water exchange regulations (Clause 51). While the majority of these clauses are the standard BIMCO clauses that have already been in practice, some are not of precisely the same content. For example, the BIMCO Slow Steaming Clause for Time Charterparties and the Clause in the NYPE 2015 broadly aims to achieve the same goal. However, the Clause 38(f) in the NYPE 2015 is substantially different to BIMCO Slow Steaming Clause for Time Charterparties in the first sentence, and has dissimilar implications for the charterer. One benefit of NYPE 2015 is that is quite up to date in certain aspects, including clauses to arrange various new issues which have appeared over recent years by including the additional provisions regarding electronic bill of lading, slow steaming, pirate, sanction, hull fouling and ballast water exchange regulations, liquefaction cargoes and others. The NYPE 2015 also provides the extensive choice of law and arbitration. Of the major changes, perhaps the most notable is the amended payment aspects under clause 11, including the grace period which allows the shipowner to use their rights if the charterer fails to pay hire within the agreed date, leading to the breach of the charterparty terms. These will provide the shipowner three banking days to withdraw from the contract.
