According to Thai society, there is inequality of legal system with LGBTQ. Although, Thai Civil and Commercial Code allows LGBTQ couples registering to be partnerships but not cover to the adopted of children and no effective regulation to support happy families of LGBTQ persons. Therefore, this paper will study the suitable guidelines to enact the legislations for LGBTQ couples having rights to adopt the children. The comparison with foreign laws to determine the rights and the duties of LGBTQ parents to adopt the children legitimately. This paper is documentary research by studying the relevant legislations, researches, policies and relevant electronic data of domestic laws and foreign laws to analyze for discovery the recommendations to amend Thai laws. From the research, we found that the adoption of LGBTQ parents is not allowed according Thai law while foreign laws are allowed. According to foreign laws, LGBTQ parents who register partnership legally are able to adopt children by following the procedures of the law. The researchers have studied Taiwan laws and English laws that found the weaknesses of Thai law that can amend by acknowledgment of LGBTQ partnerships rights in the draft of Civil Partnership Act 2004 to support the equal rights and welfares as other couples.
