265 ทรัพย์ที่มีความจาเป็นหรือความสาคัญต่อผู้เสียหายจะมีผลต่อการดาเนินคดี (2) เหตุผลสาหรับการให้อภัย หรือยอมความให้กับผู้กระทา พบว่า เหตุผลความสัมพันธ์ทางด้านครอบครัว ญาติพี่น้อง ทั้งในลักษณะที่ ชอบด้วยกฎหมายและตามความเป็นจริง พฤติกรรมการสานึกผิดการนาทรัพย์กลับคืนเจ้าของ เหล่านี้เป็น เหตุปัจจัยที่จะทาให้ผู้เสียหายให้อภัยหรือยอมความให้ผู้กระทาผิดได้เช่นกัน จึงอาจสรุปผลการศึกษาได้ว่า มีความเป็นไปได้การกาหนดให้ความผิดฐานลักทรัพย์เป็นความผิดต่อส่วนตัว ผู้วิจัยจึงมีข้อเสนอแนะ ดังนี้ 1) ควรกาหนดให้ความผิดฐานลักทรัพย์เป็นความผิดอันยอมความได้ หรือ 2) อาจกาหนดให้ยอมความได้ ภายใต้เงื่อนเกี่ยวกับราคาของทรัพย์ ความสัมพันธ์ระหว่างผู้เสียหายกับผู้กระทา ตลอดจนการสานึกผิด ของผู้กระทาและการกลับใจนาทรัพย์กลับคืนเจ้าของเหตุดังกล่าวสามารถยอมความได้ด้วยเช่นกัน คาสาคัญ: ความผิดฐานลักทรัพย์, ความผิดต่อส่วนตัว, ยอมความได้ Abstract The offense of theft is an offense against the state, but Section 71, paragraph two, except that if the theft between an ascendant and a descendant Brothers and sisters are compromising, but in reality, compromise for theft usually occurs outside of the sanctions of the law.
