32 Abstract This research aim to study the theoretical concepts concerning serious offenses and recidivism of children and youth rehabilitation correction and the criminal justice system for children and youth. and analyzing legal measures in dealing with children and young people who commit serious and repeat offenses in Thailand. To provide alternative recommendations for dealing with serious and repeat offenders in Thailand. The methodology of the research was based on the concepts and theories concerning the serious and recidivist offenses of children and young people. rehabilitation correction and the criminal justice system for children and youth. as the basis for the conceptual framework of the research. In addition, the research team has adopted the internal legal principles of Thailand. United States consisting of California, Florida and Virginia laws. as a framework for analyzing, comparing and leading to recommendations as an alternative measure for the development of relevant laws in the future The findings show that Thailand does not have specific procedures to apply to juveniles who commit serious or repeat offences. As a result, children and young people dare to commit serious offenses or repeat the same offense. Keywords: Child and Juvenile, Serious Delinquency, Recidivism บทนา ในการพัฒนาประเทศให้มีความเจริญก้าวหน้า ปฏิเสธไม่ได้เลยว่าทรัพยากรที่สาคัญที่สุดคือทรัพยากร มนุษย์ โดยเฉพาะเด็กและเยาวชนซึ่งทั่วไปทรัพยากรเหล่านี้จะกลายเป็นกาลังสาคัญในการพัฒนาประเทศใน อนาคต หากเด็กและเยาวชนได้รับการอบรมบ่มนิสัยให้เป็นพลเมืองที่ดี ทรัพยากรเหล่านี้ก็จะช่วยพัฒนาสังคมและ ทาคุณประโยชน์ในกับประเทศชาติ อย่างไรก็ดี ในความเป็นจริงเด็กและเยาวชนเป็นกลุ่มบุคคลหนึ่งที่มีความ อ่อนไหว เปราะบาง รู้เท่าไม่ถึงการณ์ และยังอ่อนด้อยประสบการณ์ในการดาเนินชีวิต เด็กและเยาวชนจึงอาจถูก ชักนาไปสู่การแสวงหาผลประโยชน์ด้วยวิธีการต่าง ๆ และอาจตกเป็นเครื่องมือของบุคคลอื่นชักจูงไปในทางที่ไม่ดี ด้วยเหตุนี้ การถูกอบรมบ่มนิสัย ให้การศึกษาและการดูแลจากบุคคลที่เกี่ยวข้อง รวมถึงรัฐ จึงเป็นปัจจัยที่สาคัญที่ จะทาให้เด็กและเยาวชนเติบโตขึ้นเป็นผู้ใหญ่ที่ดี ทั้งด้านร่างกาย จิตใจ สติปัญญา และความประพฤติ ดังคาที่กล่าว ว่า “เด็กและเยาวชนในวันนี้คืออนาคตของประเทศชาติ”
