Abstract
Human organ transplant, one of the techniques which doctors have to operate some Def. from one body
and transplant it to the patients who need to be cure, is the result of the rapid development of Medical Technology.
The rapid development of Medical Technology, is not only influenced the increasing of the needs of human organ
transplants, but also the occurred the expanding of human organ trafficking, which contrary to morals and ethics
precarious.
Moreover, the criminal case that the doctor operate the alive donor or the dead donor’s organ, which
should be trailed to defend under the criminal law. Nowadays, the unclear of the evaluation principle of human
organ trafficking and human life protection of the used of medical technology operation which will influenced the
doctors’ culpability judgment or the accomplices on the criminal confession and may be obvious of the curing and
operation development of the medical.
The purpose of this study is to investigate the criminal confession of human organ trafficking in the view
of criminal law, the trail of doctor status, donor, and the receiver for the clearance of the legal punishment
determination which religious and ethics should be analyzed. Also, the medical consideration of brain death
together with human life protection for the accurate judgment and legal punishment of the accomplices.
The study pointed out that if the criminal confession of human organ trafficking under the Thai Criminal
Code or other laws covered all doings or not. It reveals that Thailand is in accordance with deficient of human
organ trafficking. For this reason, the government should stipulate the criminal confession of human organ
trafficking in the Criminal Code or legislate the law for prevention and suppression of human organ trafficking for
transplantation. The study is truly recommended to adapt the foreign laws which are successfully used to Thai law
in order to reduce human organ trafficking in Thai society.
