บทคัดย่อ
จากการศึกษาวิจัยพบว่า ปั จจุบันรัฐธรรมนู ญแห่งราชอาณาจักรไทย พุทธศักราช 2550 ได้มีบทบัญญัติรับรอง
สิทธิ ของบุคคลที่จะมีส่วนร่วมกันกับรัฐและชุ มชนในการอนุ รักษ์ บารุ งรักษา และใช้ประโยชน์จากทรั พยากรธรรมชาติ
ซึ่ งรวมถึ งป่ าชายเลน และยังได้รับรองให้องค์กรปกครองส่วนท้องถิ่นมี อานาจหน้าที่ส่งเสริ มและรักษาคุณภาพ
สิ่งแวดล้อมตามที่กฎหมายบัญญัติ และพบว่ากฎหมายที่เกี่ยวกับป่ าชายเลนที่อยู่นอกเขตอนุรักษ์ หรื อนอกเขตพื้ นที่
คุ้มครองที่บังคับใช้อยู่ ยังไม่มีบทบัญญัติที่กาหนดให้ประชาชนเข้ามีส่วนร่วมโดยตรงในการบริ หารจัดการป่ าชายเลน
แต่เป็ นกฎหมายที่มุ่งเน้นในการคุ้มครองทรัพยากรธรรมชาติ ให้ยังคงอยู่ ในการบัญญัติกฎหมายเกี่ยวข้องกับสิทธิ ของ
ประชาชน โดยให้ประชาชนเข้ามามีส่ วนร่วมในการบริ หารจัดการป่ ายเลนอย่างชัดเจน ซึ่ งหลายพื้นที่ ได้ดาเนินการอยู ่
แล้ว ในรู ปแบบของกลุ่มประชาชนในชุมชนร่ วมกันจัดการดูแล การวิจัยจึงได้ทาการศึกษารูปแบบการจัดการป่ าชายเลน
ในพื้นที่ เขตเทศบาลเมื องสิงหนคร เพื่อจัดทาร่ างเทศบัญญัติที่เกี่ยวข้องกับป่ าชายเลน มาใช้รองรับในชุ มชนได้อย่าง
แท้จริง

Abstract
The results of this research showed that the Constitution of the Kingdom of Thailand B.E. 2550 (A.D. 2007)
provided the individuals with the right to participate in the state and communities’ protection and exploitation of
natural resources including mangrove forest. The law also allowed local administrative organizations to have the right
for protecting the environment qualities. In addition, the present law relating to mangrove forest outside a forest
conservation area and focused on the protection of natural resources. However, these Acts did not directly allow
individuals to participate in the forest administrative management. The human rights law concerning people
participation in mangrove forest management This research also studied mangrove forest management in
Singhanakorn municipality in order to launch a mangrove forest draft municipal law.
